Petition reads:
We the undersigned petition the Prime Minister to Resolve a conflict between company law & charity law & the data protection act [DPA] which deters people from being Trustees of an incorporated Charity
By company law, director`s details are published by HMG companies house, with NO control on access, use or sale of personal data [full name DoB current/previous address]
If, for personal security or to maintain professional boundaries with vulnerable clients, they use an office or `service address`, they must EACH pay £100 to request this & even if the Police agree, historical records are NOT removed-remaining in the public domain.
Companies House admit this is totally ineffective, a bad joke.
Many become charity trustees knowing that HMG charity commission will NOT reveal their address.
Many charities `incorporate` to become a limited company, so trustees become company directors, their details become public records-which can NEVER be removed even after £100 payment & police risk assessment!
This encourages identity theft, DETERS people from being Trustees, makes a mockery of the law, the DPA, HMG - their commitment to voluntary & community sector & personal privacy
